Massachusetts Bankruptcy
A decision to file for bankruptcy should be made only after determining that bankruptcy is the best way to deal with your financial problems.
AUTOMOBILE ACCIDENTS
Our office handles cases in which you have been injured and have a legal right to obtain monetary compensation for your pain and suffering. We begin our role in these cases by releasing you, our client, from the obligation of sorting out and processing the large amounts of paperwork that needs to be dealt with, just to get your initial medical bills, lost wages and bodily injury claims properly set up and administered.

Generally in these cases, our client has been injured and is going through a great deal of pain and aggravation through no fault of their own, but only because someone else was being careless. If you are a victim of this sort of carelessness or “negligence,” the last thing you need is to be burdened with filling out batches of paperwork and insurance company forms.

As a client of the Law Office of Peter R. Kaplan you will be freed from the worry and burden of insurance company paperwork and procedures and thus better able to focus upon the very important job of recuperating and rehabilitating from your injuries. Your job, will be to get well, the rest will be accomplished by our staff, including:

  • seeing to that all of your medical bills associated with the accident are paid promptly by the proper source,

  • insuring that your rights to reimbursement for lost wages and out –of –pocket expenses are exercised in a proper and timely manner

  • communicating with you and your medical providers to insure an appropriate effective treatment plan and

  • negotiating or litigating your case to conclusion wherein you will receive a fair and reasonable sum of money to compensate you for your pain and suffering.
WHAT SHOULD I DO...
IMMEDIATELY FOLLOWING A CAR ACCIDENT?

TAKE NOTICE OF YOUR INJURIES: If you are badly injured, don’t do anything. Try to remain as calm as possible and wait for help to arrive; police or paramedics.

TAKE YOURSELF AND YOUR VEHICLE OUT OF HARMS WAY: If you are not severely injured, your next step should be to see to it that you and your vehicle are out of harms way. If your car is blocking the flow of traffic, move it to the side of the roadway if possible, or alternatively set up flares or other warning devices to divert oncoming traffic. If you are unable to move your vehicle and it is blocking traffic, be sure to stand clear of the vehicle so as to avoid the possibility of being injured in a second collision.

CALL THE POLICE: Regardless of whether the accident is major or minor, it is always a good idea to contact the police as soon as possible after any motor vehicle accident. Massachusetts Law requires that any person involved in a motor vehicle accident must fill out an official Operator’s Report form and submit it within 3 days of the accident to:

  1. The local police department of the city or town in which the accident occurred.

  2. The driver’s insurance company

  3. The Massachusetts Registry of Motor Vehicles

For more information about this requirement and for a printable image of the Operator’s Report form you may visit the Massachusetts Registry of Motor Vehicles official website at www.mass.gov/rmv.

EXCHANGE AND RECORD INFORMATION
Do your best to write down all important information including:

  • Names, addresses and license numbers of all persons involved in the accident.

  • Year, make, model and color of all vehicles involved in the accident.

  • Details of the accident; date, time, location, road, and weather conditions

GET MEDICAL ATTENTION: If you have any pain directly after the collision, seek medical treatment as soon as possible. If you’re not sure how badly you are injured, it is always best to be cautious and get examined immediately at your doctor’s office or hospital emergency room. Even injuries which go unnoticed or seem minor directly after the accident can potentially be very serious and ultimately require a significant amount of medical treatment to recover fully. Under these circumstances, you should consult an attorney, who specializes in Massachusetts auto accident law to determine whether or not you need legal representation.

WHAT WILL IT COST ME TO HIRE AN ATTORNEY TO REPRESENT ME REGARDING MY AUTO ACCIDENT? The Law Office of Peter R. Kaplan handles auto accident claims for personal injury on a “contingency” fee basis. This means that you will not be charged a fee unless we are successful in winning your case. If you do receive money as a result of our efforts, our fee is 33.33% percent of your award.
