TAKE NOTICE OF YOUR INJURIES: If you are badly injured, don’t do anything. Try to remain as calm as possible and wait for help to arrive; police or paramedics.
TAKE YOURSELF AND YOUR VEHICLE OUT OF HARMS WAY: If you are not severely injured, your next step should be to see to it that you and your vehicle are out of harms way. If your car is blocking the flow of traffic, move it to the side of the roadway if possible, or alternatively set up flares or other warning devices to divert oncoming traffic. If you are unable to move your vehicle and it is blocking traffic, be sure to stand clear of the vehicle so as to avoid the possibility of being injured in a second collision.
CALL THE POLICE: Regardless of whether the accident is major or minor, it is always a good idea to contact the police as soon as possible after any motor vehicle accident. Massachusetts Law requires that any person involved in a motor vehicle accident must fill out an official Operator’s Report form and submit it within 3 days of the accident to:
- The local police department of the city or town in which the accident occurred.
- The driver’s insurance company
- The Massachusetts Registry of Motor Vehicles
For more information about this requirement and for a printable image of the Operator’s Report form you may visit the Massachusetts Registry of Motor Vehicles official website at www.mass.gov/rmv.
EXCHANGE AND RECORD INFORMATION
Do your best to write down all important information including:
- Names, addresses and license numbers of all persons involved in the accident.
- Year, make, model and color of all vehicles involved in the accident.
- Details of the accident; date, time, location, road, and weather conditions
GET MEDICAL ATTENTION: If you have any pain directly after the collision, seek medical treatment as soon as possible. If you’re not sure how badly you are injured, it is always best to be cautious and get examined immediately at your doctor’s office or hospital emergency room. Even injuries which go unnoticed or seem minor directly after the accident can potentially be very serious and ultimately require a significant amount of medical treatment to recover fully. Under these circumstances, you should consult an attorney, who specializes in Massachusetts auto accident law to determine whether or not you need legal representation.
